Welcome to Mindael. These Terms of Service ("Terms") govern your access to and use of the Mindael mobile application, website, and related services (collectively, the "Service").
By downloading, installing, or using the Service, you agree to be bound by these Terms.
You must be at least 13 years old (or 16 in the EEA) to use the Service.
Mindael is a sound therapy and wellness application providing curated ambient sounds, binaural beats, solfeggio frequencies, AI-powered recommendations, sound mixing, guided routines, mood tracking, alarm, sleep timer, and session tracking features.
Mindael is not a medical device and does not provide medical advice, diagnosis, or treatment. The Service is not a substitute for professional medical or mental health care.
You are responsible for maintaining the confidentiality of your account credentials. You may delete your account at any time through the app (You > Delete Account).
Mindael offers free and premium tiers. Premium unlocks the full sound library, unlimited mixes, AI features, and an ad-free experience. We also offer an AI Power Pack for expanded AI capabilities.
Subscriptions are processed through Apple App Store or Google Play Store. Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period.
We may offer a free trial. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription.
You may cancel your subscription at any time through your app store account settings. Cancellation takes effect at the end of the current billing period.
You agree not to reverse engineer, copy, modify, distribute, or sell any part of the Service; use the Service for unlawful purposes; interfere with the Service's operation; use automated means to access the Service; or circumvent premium content restrictions.
All content in the Service is the property of Mindael or its licensors. You retain ownership of content you create (journal entries, custom mixes) and grant us a limited license to process it for providing the Service.
AI-generated responses are for informational purposes only and are not professional advice. AI features may be subject to usage limits based on your subscription tier. We do not guarantee the accuracy of AI-generated content.
The Service is intended for general wellness and relaxation purposes only. Certain sounds, including binaural beats, may not be suitable for everyone. Consult your healthcare provider if you have any medical conditions. If you are experiencing a medical or mental health emergency, stop using the Service and contact emergency services immediately.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
TO THE FULLEST EXTENT PERMITTED BY LAW, MINDAEL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless Mindael from any claims arising out of your use of the Service or violation of these Terms.
You may stop using the Service at any time. We reserve the right to suspend or terminate your access for violation of these Terms.
These Terms shall be governed by the laws of the State of Delaware, United States.
These Terms are between you and Mindael, not Apple. Apple has no obligation to provide maintenance or support for the Service. Apple and its subsidiaries are third-party beneficiaries of these Terms.
We may modify these Terms at any time. Continued use after changes constitutes acceptance.
